Case Title: Md. Sarfaraj vs. State of Bihar

The Patna High Court granted anticipatory bail to one Mohammed Sarfaraj accused of making derogatory comments against Hindu goddess Janaki (Sita) and Laxman. He was lodged under section 153(A) and 295(A) of the IPC and section 66 of the Information Technology Act.

It is alleged in the FIR that the petitioner through Mobile No.9682318250 had posted filthy post on Facebook over Mata Janki and Laxman Ji in a group, namely, Nonveg Chutkule and Full Masti due to which religious sentiments and communal harmony was disturbed.

Apprending his arrest, the petitioner moved to the high court seeking anticipatory bail. His counsel argued that he is innocent and has falsely been implicated in the present case. He also submitted that the mobile number allegedly used for making the FB posts does not belong to him.

Learned Counsel for the State opposed the prayer for grant of anticipatory bail to the petitioner by submitting that the petitioner is the Admin of the said group.

The bench after hearing both sides granted bail to the petitioner on furnishing a bail bond of Rs.25,000/-, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
