Case Name: In Re vs Abhay Pratap
A Bench of Justices Ashwani Kumar Mishra and Vinod Diwakar of Allahabad High Court issued contempt notice to a lawyer for allegedly stalking, sending obnoxious, disturbing, indecent messages and misbehaving with woman judicial officer on Facebook.
“Issue notice to Sri Abhay Pratap, Advocate, to show cause as to why contempt proceedings should not be initiated against him under Section 2(c) of the Contempt of Courts Act, 1971, for levelling baseless insulting allegations, scandalizing and undermining the authority and dignity of the court”.
The lawyer-contemnor named Abhay Pratap who is an advocate practising at District Court, Maharajganj had sent several obnoxious messages to the woman judge on her Facebook account.
And when the concerned judge blocked the lawyer on social media, he started coming to her court.
He would sit in her court without any work, gazing at her continuously.
The officer has stated that it became difficult for her to concentrate on her work and to perform the work assigned to her. Only when no other alternative was left a first information report was lodged against the contemnor.
The bench directed that “While issuing the notices within a week, the Registry will ensure that a copy of the order passed by this court on 20th March, 2023 in Criminal Misc. Bail Cancellation Application No. 36 of 2023 is also sent along with the notice”.
