Case Title: Rajesh Kumar vs State

A single bench of Justice Prashant Kumar of Allahabad High Court recently denied to quash a case which is moved by the accused named Rajesh Kumar under section 482 of the CrPC (code of criminal procedure) who is accused of sharing objectionable image of Lord Hanuman. 

According to the FIR, the accused named Rajesh Kumar has shared a highly objectionable and disrespectful image of Lord Hanuman including offensive caption due to which he was accused of causing disruption of communal harmony, hurting religious sentiments and indulging in public mischief.

While denying the bail justice observed that “The limit of exercising jurisdiction conferred on the High Court under Section 482 CrPC is well defined, by no stretch of imagination, it could be said that the instant application filed under Section 482 CrPC fulfills the requirement as contemplated. Hence, I see no reason to interfere and entertain the instant application filed under Section 482 CrPC”.
